TERMS AND CONDITIONS

1. GENERAL

Any delivery from Mouldshop A/S (hereinafter "Mouldshop") to the customer (hereinafter "Customer") is subject to these terms of sale and delivery unless explicitly deviated from or modified by a separate written agreement. Special purchasing conditions or specific requirements concerning the purchase from the Customer’s side, such as in the Customer’s order, general purchasing conditions, tender materials, etc., are not binding for Mouldshop unless explicitly accepted in writing by Mouldshop.

All transactions conducted on Mouldshop.dk are governed by Danish law. These terms and conditions have been prepared in accordance with Danish legislation.

2. ORDER/OFFER

To transact on Mouldshop.dk, you must create an account with personal information. You are responsible for securely storing your login details.

A final and binding agreement between the Customer and Mouldshop is deemed concluded only when the Customer’s written acceptance has been confirmed by Mouldshop, e.g., by a written order confirmation.

In case of discrepancies between the order confirmation and the Customer’s order or acceptance, the order confirmation shall prevail. Any offer from Mouldshop is subject to prior sale. Unless otherwise stated in the offer, Mouldshop’s offers must be accepted by the Customer immediately and no later than 15 days after the date of the offer.

Unless a standard or quality designation is explicitly stated in the agreement, goods are delivered as ordinary commercial products without liability for special quality requirements.

Unless otherwise agreed in writing, the Customer bears full responsibility for the selection of the delivery, including ensuring that the delivery can achieve the expected results and desired functionality in relation to the Customer’s existing or intended environment and purpose.

3. PRODUCTS AND SERVICES

Technical information, guidance, certificates, etc., including product information, illustrations, drawings, and technical data such as dimensions, compatibility, performance, quality, and similar in brochures, PowerPoint presentations, prospectuses, and other promotional materials including on Mouldshop’s website, are for guidance only.

Mouldshop’s information is only binding if a specific written guarantee has been provided as part of the agreement with the Customer.

4. PRICES

All deliveries are made at the prices valid on the date Mouldshop sends the order confirmation, as stated in Mouldshop’s applicable price lists, unless a fixed price is indicated in the order confirmation.

Offers and prices listed in price lists and order confirmations exclude VAT, packaging, postage, and other additional services, which are added to the price upon invoicing the Customer.

Mouldshop reserves the right to change agreed prices without notice due to increases in terminal and transport costs, insurance, etc., occurring after the conclusion of the agreement. The same applies if Danish or foreign authorities (including the EU) impose binding interventions in pricing, such as minimum prices, anti-dumping duties, equalization duties, or other special duties, taxes, or similar.

5. SHIPPING AND DELIVERY

Any delivery time indicated by Mouldshop is estimated and non-binding unless a fixed delivery date has been explicitly agreed upon in writing for the whole or part of the delivery.

Delivery is made ex works Mouldshop’s warehouse.

If it is agreed that Mouldshop will ship the delivery from the delivery location, the costs thereof are borne by the Customer unless otherwise agreed in writing, and the shipment is at the Customer’s risk from the time the delivery leaves Mouldshop’s premises in Ballerup.

If delivery is made directly from Mouldshop’s supplier to the Customer, delivery is ex works the supplier or the specified foreign warehouse unless otherwise agreed in writing between the Customer and Mouldshop. If delivery fails due to the Customer’s circumstances, the delivery is held at the Customer’s expense and risk, and Mouldshop is entitled to charge storage fees, costs, etc.

Dropshipments are not applicable for online payment.

Shipping method and estimated delivery time are agreed upon when ordering each product. The selection of shipping methods and thus shipping costs may vary due to factors such as product weight and dimensions.

Mouldshop A/S offers free shipping on purchases over DKK 1500.

Stock items are delivered immediately from the warehouse in Ballerup, and order items are delivered within 1-3 working days also from the warehouse in Ballerup, unless otherwise indicated on the product in the webshop.

Mouldshop A/S uses the carriers PostNord and UPS for deliveries within Denmark.

Orders are generally shipped as one consolidated delivery. If partial deliveries are desired, please contact Mouldshop’s customer service at sales@mouldshop.dk. Any costs for partial deliveries will be invoiced. Free shipping applies only for one consolidated delivery or the first partial delivery, not for express/direct delivery.

Mouldshop A/S delivery methods:

Stock items – dispatched the same day as order receipt,

Direct deliveries (where possible) – for a small fee,

Small shipments – via Post Danmark,

Partial deliveries – where the customer pays the shipping costs,

Other shipments – with specially selected freight companies,

Track & trace – available on all parcel shipments.

All packages are collected about 15 minutes before closing time.

6. PAYMENT

Unless otherwise agreed in writing, all deliveries are made against cash payment, and Mouldshop is entitled to withhold delivery or prevent handing over the goods to the Customer until payment has been received.

If payment deferral is granted, the payment term runs from the delivery date.

In case of late payment, interest is charged from the due date at 1% per commenced month on the outstanding amount. The Customer may not offset any claims from other legal relations or exercise any right of retention or withhold payment due to delay, complaint, or counterclaim regarding the specific delivery. Delivered goods remain the property of Mouldshop until full and final payment has been made.

If the Customer defaults on payment for a delivery or partial delivery, Mouldshop may withhold any subsequent deliveries/partial deliveries and prevent delivery until the Customer’s total outstanding debt is paid.

For online purchases, Mouldshop A/S offers online payments by Dankort, VISA, or Mastercard, which are charged immediately once the goods are shipped from Mouldshop’s warehouse in Ballerup.

For all customers, both with and without an account, additional payment options include common credit and debit cards such as Visa, MasterCard, and Dankort.

Prices on Mouldshop A/S’s website are in Danish kroner (DKK). All prices exclude VAT, which is added at checkout.

Mouldshop A/S uses a secure payment server encrypting all data with SSL protocol, ensuring all data is protected and unreadable by third parties.

7. CANCELLATION AND RETURNS

If the Customer cancels a delivery, the Customer is obliged to indemnify Mouldshop for any loss and expenses Mouldshop may incur in connection, including vis-à-vis Mouldshop’s suppliers.

Deliveries are not accepted for return. If Mouldshop in special cases accepts a return of all or part of a delivery, a fee of at least 20% of the paid purchase price for the returned delivery will be charged. Returns are otherwise at the Customer’s cost and risk.

Return requires that the returned delivery is undamaged and, for packaged materials, returned in the original packaging.

8. COMPLAINTS AND DEFECTS

The Customer must immediately inspect the delivered goods for defects. Mouldshop is only liable for original defects.

If the Customer finds original defects, they must immediately contact Mouldshop’s customer service at sales@mouldshop.dk in writing specifying the defects claimed. Failure to complain immediately after an original defect is or should have been discovered voids the right to claim the defect.

All claims must be made within 4 weeks after the actual delivery date. Failure to do so means the Customer cannot subsequently claim defects. Mouldshop’s liability is limited to remedying the defect, replacement delivery, or granting a proportional discount. The Customer cannot claim compensation of any kind.

Await return mail with an RMA number from customer service

Return the goods to Mouldshop A/S, Baltorpbakken 10, DK-2750 Ballerup, Denmark

Include a copy of the completed complaint form (including RMA number) with the goods as documentation

Upon receipt, Mouldshop will inspect the goods and respond to the claim.

Note: Returns without a completed complaint form will not be processed.

9. SPECIAL CONDITIONS FOR USED GOODS

For used goods, including items previously used by Mouldshop, section 8 (Complaints and defects) does not apply.

Used goods are sold as-is and as found at the time of delivery, without any warranty or liability for defects. Except for claims regarding legal defects, the Customer cannot claim any defects against Mouldshop for used goods.

10. DELAYED DELIVERY

If no fixed delivery date is agreed, the Customer may issue a written demand for delivery, granting Mouldshop at least 10 working days to deliver.

If Mouldshop exceeds an agreed fixed delivery date or the set delivery deadline by more than 10 working days, the Customer is entitled to cancel the agreement, unless the delay is due to circumstances beyond Mouldshop’s control (see section 13, Force Majeure). This does not apply to orders of custom-made goods.

Mouldshop is not liable for delays caused by suppliers. If the Customer cancels, they are entitled only to a refund of any pre-paid amounts for the delayed delivery and not for other claims. No other breach remedies or compensation can be claimed.

11. PRODUCT LIABILITY

Mouldshop’s product liability is limited to mandatory provisions in the Danish Product Liability Act that cannot be waived. Mouldshop disclaims any other basis for product liability. Liability is capped at the coverage of Mouldshop’s product liability insurance. The Customer must immediately notify Mouldshop in writing if a product liability claim arises or is likely to arise. The Customer must indemnify Mouldshop to the extent Mouldshop’s liability is limited under this clause.

12. LIMITATION OF LIABILITY

Mouldshop is not liable for indirect or consequential damages such as loss of business, loss of goodwill, lost savings, or similar. Liability is always limited to the purchase price paid for the specific delivery.

13. FORCE MAJEURE

Mouldshop is not liable for non-fulfillment or delayed fulfillment caused by circumstances beyond its control, including war, rebellion, terrorism, natural disasters, strikes, shortage of goods, supplier delays, fire, transport issues, currency restrictions, government actions, death, illness, or departure of key personnel.

Mouldshop may postpone delivery or terminate the agreement in such cases without liability.

14. GOVERNING LAW AND JURISDICTION

Any disputes shall be resolved under Danish law, excluding the CISG and Danish international private law rules. Venue is Glostrup, and proceedings shall be in Danish.

15. PERSONAL DATA AND DATA PROTECTION

Mouldshop A/S takes the protection of your personal data seriously. All data collected via our webshop is processed confidentially and in accordance with applicable data protection laws, including the EU GDPR. Data is used solely to facilitate your use of our services such as order processing and customer support. We do not share your data with third parties without your consent unless required by law. You have the right to access, correct, or delete your data. See our Privacy Policy for more details.

16. CHANGES TO TERMS AND CONDITIONS

We reserve the right to modify these terms. Changes will be communicated via the webshop or email.
